En el nombre de la Santísima Trinidad,
La Santa Sede Apostólica y la República Dominicana, animadas del deseo de asegurar una fecunda colaboración para el mayor bien de la vida religiosa y civil de la Nación Dominicana, han determinado estipular un Concordato que constituya la norma que ha de regular las recíprocas relaciones de las Altas Partes contratantes, en conformidad con la Ley de Dios y la tradición católica de la República Dominicana.
A este fin Su Santidad el Sumo Pontífice Pío XII ha nombrado por su Plenipotenciario a:
 Papa Pío XII y Mons. Tardini Su Excelencia Reverendísima Monseñor Domenico Tardini, Pro Secretario de Estado para los Asuntos Eclesiásticos Extraordinarios, y Su Excelencia el Presidente de la República Dominicana ha nombrado por su Plenipotenciario a :
Su Excelencia el Generalísimo Dr. Rafael Leonidas Trujillo Molina.
 Trujillo y Balaguer en 1954 Ambos Plenipotenciarios, después de confrontar sus respectivos Plenos Poderes y hallarlos en debida forma expedidos, acordaron lo siguiente :
Artículo I.
1.La Religión Católica, Apostólica, Romana sigue siendo la de la Nación Dominicana y gozará de los derechos y de las prerrogativas que le corresponden en conformidad con la Ley Divina y el Derecho Canónico.
Artículo II.
1.El Estado Dominicano reconoce la personalidad jurídica internacional de la Santa Sede y del Estado de la Ciudad del Vaticano.
2.Para mantener, en la forma tradicional, las relaciones amistosas entre la Santa Sede y el Estado Dominicano, continuarán acreditados un Embajador de la República Dominicana cerca de la Santa Sede y un Nuncio Apostólico en Ciudad Trujillo. Este será el decano del Cuerpo Diplomático, en los términos del derecho consuetudinario.
Artículo III.
1.El Estado Dominicano reconoce a la Iglesia Católica el carácter de sociedad perfecta y le garantiza el libre y pleno ejercicio de su poder espiritual y de su jurisdicción, así como el libre y público ejercicio del culto.
2.En particular, la Santa Sede podrá sin impedimento promulgar y publicar en la República Dominicana cualquier disposición relativa al gobierno de la Iglesia y comunicarse con los Prelados, el clero y los fieles del País, de la misma manera que éstos podrán hacerlo con la Santa Sede. Gozarán de las mismas facultades los Ordinarios y las otras Autoridades eclesiásticas en lo referente a su clero y fieles.
Artículo IV.
1.El Estado Dominicano reconoce la personalidad jurídica a todas las instituciones y asociaciones religiosas, existentes en la República Dominicana a la entrada en vigor del presente Concordato, constituidas según el Derecho Canónico; en particular a las Diócesis y a la Prelatura nullius con sus instituciones anejas, a las Parroquias, a las Ordenes y Congregaciones religiosas; a las Sociedades de vida común y a los Institutos seculares de perfección cristiana canónicamente reconocidos, sean de derecho pontificio o de derecho diocesano, a sus provincias y a sus casas. Las Autoridades eclesiásticas competentes comunicarán al departamento correspondiente del Gobierno Dominicano la lista de las instituciones y asociaciones religiosas que se acaban de mencionar, dentro de los dos meses que sigan a la ratificación de este Concordato.
2.Gozarán de igual reconocimiento las entidades de la misma naturaleza que sean ulteriormente erigidas o aprobadas en la República Dominicana por las Autoridades eclesiásticas competentes, con la sola condición de que el decreto de erección o de aprobación sea comunicado oficialmente por escrito a las Autoridades competentes del Estado.
Artículo V..
1.Cuando la Santa Sede proceda al nombramiento de un Arzobispo u Obispo residencial o su Coadjutor con derecho a sucesión, comunicará al Gobierno Dominicano el nombre de la persona escogida, a fin de saber si contra ella existen objeciones de carácter político general. El silencio del Gobierno, pasados treinta días a contar de la precitada comunicación, se interpretará en el sentido de que no existe objeción. Todas estas gestiones se conducirán en el más estricto secreto.
2.Al hacer las designaciones de Arzobispo y Obispos, el Santo Padre tendrá en cuenta a los sacerdotes, idóneos para estas funciones, que sean ciudadanos dominicanos. Sin embargo, el Santo Padre podrá, cuando lo juzgue necesario y conveniente para el mayor bien religioso del País, por razón de la escasez de sacerdotes dominicanos, elegir para tal dignidad otros sacerdotes, que no sean de nacionalidad dominicana.
Artículo VI..
1.La organización y circunscripción eclesiástica, del territorio de la República Dominicana queda constituida así : Arquidiócesis Metropolitana de Santo Domingo ; Diócesis de Santiago de los Caballeros; Diócesis de La Vega; Prelatura nullius de San Juan de la Maguana.
2.Para la erección de una nueva Diócesis o Prelatura nullius y para otros cambios de circunscripciones diocesanas que pudieran juzgarse necesarias, la Santa Sede se pondrá previamente de acuerdo con el Gobierno Dominicano, salvo si se tratase de mínimas rectificaciones de territorio reclamadas por el bien de las almas.
Artículo VII..
1.El Gobierno Dominicano se compromete a construir la Iglesia Catedral o Prelaticia y los edificios adecuados que sirvan de habitación del Obispo o Prelado nullius y de oficinas de la Curia, en las Diócesis y Prelatura nullius actualmente existentes que lo necesiten, y en las que se establezcan en el futuro.
2.Además el Gobierno asegura a la Arquidiócesis de Santo Domingo y a cada Diócesis o Prelatura nullius actualmente existentes o que se erijan en el futuro una subvención mensual para los gastos de administración y para las iglesias pobres.
Artículo VIII..
Al Arzobispo de Santo Domingo corresponde el título de Primado de Indias de acuerdo con la Bula de Pío VII Divinis praeceptis del 28 de noviembre de 1816.
Se confirman a la Iglesia Metropolitana de Santo Domingo el título, los derechos y privilegios de Basílica Menor, que le otorgó Benedicto XV en su Breve Inter Americae del 14 de junio de 1920.
Artículo IX..
1.La erección, modificación o supresión de parroquias, beneficios y oficios eclesiásticos, así como el nombramiento del Vicario General, oficiales de la Curia, párrocos y todo sacerdote o funcionario encargado de cualquier oficio eclesiástico serán hechos por las Autoridades eclesiásticas competentes, ciñéndose a las disposiciones del Derecho Canónico. Sin embargo las Autoridades eclesiásticas correspondientes comunicarán al Gobierno con la mayor rapidez el nombramiento del Vicario General, de los párrocos y, en caso de vacancia de una parroquia, del vicario encargado de la misma. Al hacer estas designaciones, las Autoridades eclesiásticas preferirán, a ser posible, a sacerdotes idóneos que sean ciudadanos dominicanos.
2.La eventual objeción del Gobierno al comportamiento de un funcionario eclesiástico será objeto de consideración y decisión por las Autoridades eclesiásticas competentes.
Artículo X..
1.Las Autoridades eclesiásticas podrán usar los servicios y la cooperación del clero extranjero, secular o religioso, y confiar a sacerdotes extranjeros dignidades, oficios y beneficios eclesiásticos, cuando lo juzguen conveniente para el bien del País o de su Diócesis o Prelatura.
2.Los sacerdotes, religiosos y religiosas extranjeros, que la Autoridad eclesiástica invite al País para ejercer su ministerio o desenvolver las actividades de su apostolado, estarán exentos de cualquier tasa o impuesto de inmigración.
3.Los Superiores generales y provinciales de las Ordenes y Congregaciones religiosas, que residen fuera del territorio dominicano, aunque sean de otra nacionalidad, tienen el derecho de visitar, por sí o por otras personas, sus casas religiosas situadas en la República Dominicana.
Artículo XI..
1.Los eclesiásticos gozarán en el ejercicio de su ministerio de una especial protección del Estado.
2.Los eclesiásticos no podrán ser interrogados por jueces u otras autoridades sobre hechos o cosas cuya noticia les haya sido confiada en el ejercicio del sagrado ministerio y que por lo tanto caen bajo el secreto de su oficio espiritual.
3.Los clérigos y los religiosos no estarán obligados a asumir cargos públicos o funciones que, según las normas del Derecho Canónico, sean incompatibles con su estado.
Para poder ocupar otros empleos o cargos públicos, necesitarán el Nihil obstat de su Ordinario propio y del Ordinario del lugar donde hubieren de desempeñar su actividad. Revocado el Nihil obstat, no podrán continuar ejerciéndolos.
Artículo XII..
Los clérigos, los seminaristas de filosofía y teología y los religiosos, ya sean profesos o novicios, están exentos del servicio militar, salvo el caso de movilización general.
En caso de movilización general, los sacerdotes prestarán el servicio militar en forma de asistencia religiosa; los demás clérigos y religiosos serán enviados a las organizaciones sanitarias y de la Cruz Roja.
Estarán exentos del servicio militar, aún en el caso de movilización general, los Obispos, los sacerdotes que tengan cura de almas, como los párrocos y coadjutores, y los sacerdotes necesarios al servicio de las Curias diocesanas o prelaticias y de los Seminarios.
Artículo XIII.
En caso de que se levante acusación penal contra alguna persona eclesiástica o religiosa, la Jurisdicción del Estado apoderada del asunto deberá informar oportunamente al competente Ordinario del lugar y transmitir al mismo los resultados de la instrucción, y, en caso de darse, comunicarle la sentencia tanto en primera instancia como en apelación, revisión o casación.
En caso de detención o arresto el eclesiástico o religioso será tratado con el miramiento debido a su estado y a su grado.
En el caso de condena de un eclesiástico o de un religioso, la pena se cumplirá, en cuanto sea posible, en un local separado del destinado a los laicos, a menos que el Ordinario competente hubiese reducido al estado laical al condenado.
Artículo XIV.
El uso del hábito eclesiástico o religioso por personas eclesiásticas o religiosas a quienes haya sido prohibido por orden de las competentes Autoridades eclesiásticas, oficialmente comunicada a las Autoridades del Estado, así como el uso abusivo del mismo hábito por otras personas, será castigado con las mismas penas previstas para el caso de uso abusivo del uniforme militar. Será castigado en los mismos términos el ejercicio abusivo de jurisdicción o funciones eclesiásticas.
Artículo XV.
1.La República Dominicana reconoce plenos efectos civiles a cada matrimonio celebrado según las normas del Derecho Canónico.
2.En armonía con las propiedades esenciales del matrimonio católico queda entendido que, por el propio hecho de celebrar matrimonio católico, los cónyuges renuncian a la facultad civil de pedir el divorcio, que por esto mismo no podrá ser aplicado por los tribunales civiles a los matrimonios canónicos.
Artículo XVI.
1.Las causas concernientes a la nulidad del matrimonio canónico y la dispensa del matrimonio rato y no consumado, así como el procedimiento relativo al Privilegio Paulino, quedan reservados a los Tribunales y a los órganos eclesiásticos competentes.
La Santa Sede consiente que las causas matrimoniales de separación de los cónyuges sean juzgadas por los Tribunales civiles.
2.Las decisiones y sentencias de los órganos y Tribunales eclesiásticos, cuando sean definitivas, se elevarán al Supremo Tribunal de la Signatura Apostólica para su comprobación y serán transmitidas después, con los respectivos decretos de dicho Supremo Tribunal, por vía diplomática al Tribunal dominicano competente, que las hará efectivas y mandará que sean anotadas en los registros civiles al margen del acta del matrimonio.
Artículo XVII.
El Estado Dominicano garantiza la asistencia religiosa a las fuerzas armadas de tierra, mar y aire y a este efecto se pondrá de acuerdo con la Santa Sede para la organización de un cuerpo de capellanes militares, con graduación de oficiales, bajo la jurisdicción del Arzobispo Metropolitano en lo que se refiere a su vida y ministerio sacerdotal, y sujetos a la disciplina de las fuerzas armadas en lo que se refiere a su servicio militar.
Artículo XVIII.
1)los días de precepto establecidos en toda la Iglesia por el Código de Derecho Canónico, es decir:
— todos los domingos;
— las fiestas de Circuncisión (1 de enero), Epifanía (día de Reyes, 6 de enero), San José (19 de marzo), Ascensión, Corpus Christi, Santos Apóstoles Pedro y Pablo (29 de junio), Asunción (15 de agosto), Todos los Santos (1 de noviembre), Inmaculada Concepción (8 de diciembre), Navidad de Nuestro Señor Jesucristo (25 de diciembre);
2)además los días de precepto establecidos en la República Dominicana, es decir:
— festividad de Ntra. Sra. de la Altagracia (21 de enero);— festividad de Ntra. Sra. de las Mercedes (24 de septiembre).
El Estado dará en su legislación las facilidades necesarias para que los fieles puedan cumplir en esos días sus deberes religiosos.
Las Autoridades civiles, tanto nacionales como locales, velarán por la debida observancia del descanso en los días festivos.
Artículo XIX..
1.El Gobierno Dominicano facilitará la necesaria asistencia religiosa a los establecimientos nacionales, como son los colegios, los hospitales, los asilos de ancianos o de niños, las cárceles, etc.
A tal fin, si el establecimiento no tiene capellán propio, el Estado permitirá el libre acceso y el ejercicio de la asistencia espiritual en dicho establecimiento al párroco del lugar o al sacerdote encargado por el Ordinario competente.
2.En los asilos, orfanatos, establecimientos o instituciones oficiales de educación, corrección y reforma de menores dependientes del Estado, se enseñará la religión católica y se asegurará la práctica de sus preceptos.
3.El Gobierno Dominicano, cuando sea posible, confiará a religiosos y religiosas la dirección de los hospitales, asilos y orfanatos y otras instituciones nacionales de caridad. La Santa Sede, por su parte, favorecerá tal proyecto.
Artículo XX.
1.La Iglesia podrá libremente fundar Seminarios o cualesquiera otros institutos de formación o de cultura eclesiástica; su régimen no estará sujeto a la fiscalización del Estado.
2.Los títulos, grados, certificados y comprobaciones escolares otorgados por tales centros tendrán la misma fuerza que los concedidos por los establecimientos del Estado en el orden correspondiente. En vista de ello la Autoridad eclesiástica comunicará a la competente Autoridad del Estado los textos adoptados en dichas instituciones para la enseñanza de las disciplinas que no sean teológicas y filosóficas.
3.Los grados académicos adquiridos en las Universidades o Institutos Pontificios de Altos Estudios serán reconocidos en la República Dominicana, para todos sus efectos civiles, como los grados conferidos y reconocidos por el Estado.
Artículo XXI.
1.El Estado Dominicano garantiza a la Iglesia Católica la plena libertad de establecer y mantener, bajo la dependencia de la Autoridad eclesiástica, escuelas de cualquier orden y grado. En consideración de la utilidad social que de ellas deriva a la Nación, el Estado las amparará y procurará ayudarlas también mediante congruas subvenciones.
La enseñanza religiosa en dichas escuelas siempre será organizada e impartida libremente por la Autoridad eclesiástica.
2.Los exámenes y pruebas de aprovechamiento para la concesión de certificados y títulos oficiales de estudio a los alumnos de las escuelas secundarias y normales dependientes de la Autoridad eclesiástica se celebrarán, a petición de ésta, en los mismos establecimientos, por medio de comisiones especiales compuestas, al menos parcialmente, por docentes del plantel
3.Los exámenes y pruebas de aprovechamiento para la concesión de certificados y títulos oficiales de estudio a los alumnos de las escuelas secundarias y normales dependientes de la Autoridad eclesiástica se celebrarán, a petición de ésta, en los mismos establecimientos, por medio de comisiones especiales compuestas, al menos parcialmente, por docentes del plantel.
Artículo XXII.
1.La enseñanza suministrada por el Estado en las escuelas públicas estará orientada por los principios de la doctrina y de la moral católicas.
2.En todas las escuelas públicas primarias y secundarias se dará enseñanza de la religión y moral católicas —según programas fijados de común acuerdo con la competente Autoridad eclesiástica— a los alumnos cuyos padres, o quienes hagan sus veces, no pidan por escrito que sean exentos.
3.Para dicha enseñanza sólo se utilizarán textos previamente aprobados por la Autoridad eclesiástica, y el Estado nombrará maestros y profesores que tengan un certificado de idoneidad expedido por el Ordinario competente. La revocación de tal certificado les priva, sin más, de la capacidad para la enseñanza religiosa.
En la designación de estos maestros y profesores el Estado tendrá en cuenta las sugestiones de la Autoridad eclesiástica y, en las escuelas secundarias y normales, cuando haya sacerdotes y religiosos en número suficiente y los proponga el Ordinario del lugar, les dará la preferencia sobre los seglares.
4.El párroco, por sí o por su delegado, tendrá acceso a las escuelas primarias para dar lecciones catequísticas periódicas.
5.Los Ordinarios de los lugares podrán cerciorarse, por sí mismos o por sus delegados, mediante visitas a las escuelas, del modo como se da la enseñanza de la religión y moral.
6.El Estado cuidará de que en las instituciones y servicios de información que estén a su cargo, y en particular en los programas de radio-difusión y televisión, se dé el conveniente puesto a la exposición y defensa de la verdad religiosa, por medio de sacerdotes y religiosos designados de acuerdo con el Ordinario competente.
Artículo XXIII.
1.El Estado Dominicano reconoce a las instituciones y asociaciones religiosas, de quienes trata el art. IV, la plena capacidad de adquirir, poseer y administrar toda clase de bienes.
2.La gestión ordinaria y extraordinaria de los bienes pertenecientes a entidades eclesiásticas o asociaciones religiosas y la vigilancia e inspección de dicha gestión de bienes corresponderán a las Autoridades competentes de la Iglesia.
3.La República Dominicana reconoce y garantiza la propiedad de la Iglesia sobre los bienes muebles e inmuebles que el Estado reconoció como pertenecientes a ella con la Ley n. 117 del 20 de abril de 1931, aclarada por Ley n. 390 del 16 de septiembre de 1943, así como de los bienes que, después de tal fecha, la Iglesia ha legítimamente adquirido o adquiera, incluidos los que han sido o sean declarados monumentos nacionales.
La República Dominicana declara propiedad de la Iglesia también todos los templos y otros edificios con fines eclesiásticos que el Estado ha venido construyendo desde el año 1930 y construya en adelante.
4.La Iglesia puede recibir cualquiera donación destinada a la realización de sus fines, y organizar colectas especialmente en el interior o a la puerta de los templos y de los edificios y lugares que le pertenezcan.
Artículo XXIV.
1.Los edificios sagrados, los Seminarios y otros edificios destinados a la formación del clero, los edificios de propiedad de la Iglesia empleados en fines de utilidad pública, las residencias de los Obispos y de los ministros del culto, cuando sean propiedad de la Iglesia, estarán exentos de cualquier impuesto o contribución.
Queda expresamente convenido que los bienes, cuya propiedad adquiera la Iglesia por donación entre vivos o por disposición testamentaria, estarán exentos de los impuestos de donación o de sucesión, siempre que los bienes recibidos en esa forma, se destinen a un fin propio del culto o de utilidad pública por voluntad del donante o del testante o por ulterior disposición de la Autoridad eclesiástica competente.
2.Los bienes eclesiásticos no comprendidos en el número precedente no podrán ser gravados con impuestos ni contribuciones especiales.
3.Los eclesiásticos estarán exentos de cualquier impuesto o contribución en razón del ejercicio de su ministerio espiritual.
4.Los Ordinarios de los lugares y los rectores de parroquias gozarán de franquicia postal y telegráfica en su correspondencia oficial en el País.
5.Los edictos y avisos que se refieren al ministerio sagrado, fijados en las puertas de los templos, estarán exentos de cualquier impuesto o contribución.
Artículo XXV.
Estado garantiza el derecho de libre organización y funcionamiento de las asociaciones católicas con fin religioso, social y caritativo, y en particular de las asociaciones de Acción Católica bajo la dependencia de los Ordinarios de los lugares.
Artículo XXVI.
Los domingos y fiestas de precepto, así como los días de Fiesta Nacional en todas las Iglesias Catedrales, Prelaticias y parroquiales de la República Dominicana se rezará o cantará al final de la función litúrgica principal una oración por la prosperidad de la República y de su Presidente
Artículo XXVII.
Las demás materias relativas a personas o cosas eclesiásticas que no hayan sido tratadas en los artículos precedentes serán arregladas según el Derecho Canónico vigente.
Si en el porvenir surgiere alguna duda o dificultad sobre la interpretación del presente Concordato, o fuere necesario arreglar cuestiones relativas a personas o cosas eclesiásticas, que no hayan sido tratadas en los artículos precedentes y que toquen también el interés del Estado, la Santa Sede y el Gobierno Dominicano procederán de común inteligencia a solucionar amigablemente la diferencia.
Artículo XXVIII.
1.El presente Concordato, cuyos textos en lengua española e italiana hacen fe por igual, entrará en vigor desde el momento del canje de los instrumentos de ratificación, el cual deberá verificarse en el término de los dos meses subsiguientes a la firma.
2.Con la entrada en vigor de este Concordato, se entienden derogadas todas las disposiciones contenidas en Leyes, Decretos, Ordenes y Reglamentos que, en cualquier forma, se opongan a lo que en él se establece.
El Estado Dominicano promulgará, en el plazo de seis meses, las disposiciones de derecho interno que sean necesarias para la ejecución de este Concordato.
En fe de lo cual, los Plenipotenciarios firman el presente Concordato.
Hecho en doble ejemplar.

PROTOCOLO FINAL
En el momento de proceder a la firma del Concordato que hoy se concluye entre la Santa Sede y la República Dominicana, los Plenipotenciarios que subscriben han hecho, de común acuerdo, las siguientes declaraciones que formarán parte integrante del mismo Concordato :
En relación con el artículo VII, n. 2
En ejecución de lo dispuesto en el art. VII, n. 2, del Concordato, el Gobierno de la República Dominicana dará:
a) a la Curia arquidiocesana de Santo Domingo la suma de quinientos pesos oro mensuales;
b) a las Curias de cada otra Diócesis o Prelatura nullius la suma de trecientos pesos oro mensuales.
En relación con el artículo X
Cuando se trate de llamar a la República Dominicana a una Orden o Congregación religiosa extranjera la Autoridad eclesiástica competente lo notificará al Gobierno.
En relación con el artículo XV
A) Para el reconocimiento, por parte del Estado, de los efectos civiles del matrimonio canónico, será suficiente que el acta del matrimonio sea transcrita en el Registro civil correspondiente. Esta transcripción se llevará a cabo de la siguiente manera :
El Párroco, dentro de los tres días siguientes a la celebración del matrimonio canónico, transmitirá copia textual del acta de la celebración al competente Oficial del Estado civil para que proceda a la oportuna transcripción.
Dicha transcripción debe realizarse dentro de los dos días siguientes a la recepción de la misma acta, y dentro de los tres días de haberla transcrito el Oficial del Estado civil hará la oportuna notificación al Párroco indicando la fecha.
El Párroco que sin graves motivos deje de enviar copia del acta matrimonial dentro del plazo citado incurrirá en pena de desobediencia, y el funcionario del Registro civil que no lo transcriba a su tiempo incurrirá en las sanciones que señale la ley orgánica de su servicio.
B) Se entiende que los efectos civiles de un matrimonio debidamente transcrito regirán a partir de la fecha de la celebración canónica de dicho matrimonio. Sin embargo, cuando la transcripción del matrimonio sea solicitada una vez transcurridos cinco días de su celebración, dicha transcripción no perjudicará los derechos adquiridos, legítimamente, por terceras personas.
No obsta a la transcripción la muerte de uno o de ambos cónyuges.
En relación con el artículo XX
1. La Santa Sede otorga al Seminario Conciliar de Santo Tomás de Aquino en Ciudad Trujillo el título de Instituto Pontificio.
Para este fin el Gobierno se compromete a hacer en el edificio que donó al Seminario las ampliaciones que las Partes de común acuerdo juzguen necesarias y a contribuir a sufragar los gastos de dicha institución con una aportación mensual de quince pesos oro por cada seminarista dominicano que allí curse sus estudios.
2. Con el fin de levantar cada vez más el prestigio del clero nacional, el Estado sostendrá cuatro becas de seminaristas dominicanos que la Autoridad eclesiástica envíe a cursar sus estudios en los Ateneos Pontificios en Roma.
En relación con el artículo XXI
Queda entendido que:
1. Para la apertura de escuelas dependientes de la Autoridad eclesiástica no se exige licencia alguna ni otra formalidad.
2. La vigilancia del Estado, por lo que atañe a las escuelas dependientes de la Autoridad eclesiástica, se referirá a lo tocante a las normas de seguridad e higiene, así como, limitadamente a los establecimientos mencionados en el n. 2 del presente articulo, al desarrollo de los programas de estudio ; y siempre se efectuará teniendo en cuenta el carácter especial de dichas escuelas y de acuerdo con la Autoridad eclesiástica correspondiente.
En relación con el artículo XXIII
1. El Estado no procederá a declarar monumentos nacionales otras propiedades eclesiásticas sino de acuerdo con la competente Autoridad religiosa.
2. Se entiende que un bien eclesiástico declarado monumento nacional es inalienable, y que la Autoridad eclesiástica, propietaria del inmueble, no procederá a modificaciones o reformas de éste sino de acuerdo con la Autoridad civil competente.
En relación con el artículo XXVI
La oración será la siguiente :

QUE ES EL CONCORDATO

Cualquier persona dentro del conglomerado de ciudadanos criollos ya ha tenido que haberse inquietado y despabilado su curiosidad por saber ¿qué es un Concordato en general? Así como ¿qué es el Concordato firmado entre el dictador Trujillo y el Vaticano-Papado o la Iglesia Católica, Apostólica y Romana?
Y una vez que haya tenido las correspondientes respuestas en forma certera y concreta, de seguro que su curiosidad, que es la partera de la duda (del famoso cogito ergo sum, del pienso (luego) por tanto existo de Renato Descartes), ante esa persona surgirá como meta conocer el proceso seguido para la obsesiva demanda a escala mundial de la firma de Concordatos, de parte de la Iglesia Católica-Papado y Vaticano con los Estados nacionales, lo de Papado primeramente -esto hasta el 1929 en que Mussolini, el sanguinario dictador nazi-fascista italiano efectúa el Pacto de Letrán entre él y el Papa Pío XI, donde acuerdan crear un llamado Estado Vaticano, que no se cimenta ni sustenta en una nación ni posee una población propia, sino que es más bien una entelequia, como una ciudad creada de chatarras de naves perdidas en el espacio, pero que tendrá como medio de su sustento el parasitismo más atroz de dicho Estado Vaticano representativo de la Iglesia Católica, Apostólica y Romana sobre los pueblos y Estados con los que logren diligenciar y obtener los susodichos Concordatos-; desde el 1929, tras Mussolini haber creado, con la inescrupulosidad peculiar de su condición de hiena prostituida de dos patas, el Estado Vaticano, pues, los Concordatos de la Iglesia Católica con los Estados nacionales serían entre el Estado Vaticano (Iglesia Católica, Apostólica y Romana), de un lado y del otro lado el Estado o la República correspondiente.
El primer Concordato firmado entre un Estado nacional, como era Italia, y el Vaticano, fue precisamente el Concordato del Duce fascista, sanguinario y depredador Benito Mussolini con el nombrado Ambrogio Damiano Achille Ratti, que se encubre bajo el seudónimo o alias de la superstición católica cristiana de Papa Pío XI o Pontífice, que significaría algo así como máxima figura supersticiosa a la que sus legiones oscurantistas y supersticiosas, seducidas por los engaños y falacias imaginarios y fantásticos, deben obediencia ciega y absoluta.
Los Concordatos, o El Concordato, tomado en sentido genérico o general, no es otra cosa que el acuerdo leonino firmado o acordado entre un dictador, tirano o sátrapa que usurpa la representación del Estado nacional al que pertenece, de un lado, y del otro, hoy día El Vaticano, representado por el emperador de los emperadores, que son a su vez los reyes de reyes, que es lo que les correspondería, según la definición que de la condición de Papa se esmera en dar el Papa Inocencio III, quien se jactaba, cimbreándose en el estercolero de su irónico cinismo y decía:
“El Papa es Vicario de Jesucristo, sucesor de Pedro, Cristo del Señor, dios del Faraón (léase bien, dios del Faraón, el emperador, dios del emperador), más acá de dios, más allá del hombre, menos que dios, mayor que el hombre”.
Según su contenido, todos los Concordatos de la época actual, incluido el tan cuestionado de España, cuya población desesperado clama con el alma saliéndosele por la boca que se le ponga fin ya ¡por dios!, son contratos leoninos en los que el Estado Nacional usurpado por el dictador, tirano o sátrapa como Trujillo (instrumento infernal entregado a la Iglesia Católica), que era todo eso y mucho más, aporta toda fuente de financiamiento de la empresa en sus tareas comerciales, cubre todos los costos, facilidades de enriquecimiento y acumulo de patrimonio para la Iglesia Católica y el personal jerárquico suyo de cardenales, obispos, monseñores y nuncios, como de los sacerdotes castrenses que ostentan elevados rangos dentro de la Policía y las FF.AA. o represivas del Estado de que se trate, mientras que el llamado Estado Vaticano o Estado chatarra y parasitario, no aporta absolutamente nada beneficioso ni concreto en términos de riquezas, bienes materiales ni mucho menos de los órdenes morales, espirituales, intelectuales ni artísticos ni a la población del Estado nacional ni a que éste asuma un carácter libre, soberano ni independiente, imposibilitándole así acceder, o sea, llegar a ser, un Estado Democrático de Derecho.
Un Concordato no es otra cosa que la escenificación del pocker cínico entre un potentado de riquezas inconmensurables, por un lado, y por el otro el vicioso mendigo exponente del arquetipo del hombre lleno de miserias. Ahí solamente puede haber un solo y único ganador.
Es que la Iglesia Católica-Vaticano, una vez obtenido el Concordato, tiene las manos libres para respaldar los más grandes crímenes y monstruosidades contra la población que el dictador, sátrapa o tirano ha burlado al pactar con el Vaticano el Concordato.
Pero al mismo tiempo que la Iglesia Católica-Vaticano ha obtenido una mina de oro inagotable que hará desviar torrentes de millones de dinero hacia el seno de la Iglesia Católica-Vaticano, en este Estado nacional la población se ve hundida en la más extrema indigencia, miseria, pobreza, huérfana de protección, desterradas sus esperanzas de mejoras concretas en su perra existencia, signada fatalmente por las calamidades y sufrimientos inigualables. Esas poblaciones sólo reciben el cínico consuelo de no preocuparse, que los ricos y pudientes no llegarán al reino del paraíso de su dios o Jesucristo después de muertos, sino sólo ellos, ya que el reino de su dios es de los pobres. Esa población, que carece de vivienda, de alimento, ropa (en lugar de lo que obtiene andrajos), carente de medicina para contrarrestar el ataque despiadado de enfermedades: gripe, diarreas, sarnas, anemia, sin hospitales y sin acceso a médicos, etc., recibe de la Iglesia Católica-Vaticano la voz consoladora de que eso es una prueba que su dios Jesucristo le impone para comprobar su fe y confianza en él. Que sean valientes, que después de muertos, alcanzarán el reino.
El contrato leonino llamado Concordato entre el dictador, tirano, sátrapa, ladrón, criminal, degenerado y depravado, el primer católico y el más anti-comunista de América, al que la Iglesia Católica-Vaticano prometiera, por medio de voces sibilinas y siniestros cantos de sirena emanados de las oscuridades lúgubres y crueles del seno de la sagrada Iglesia Católica, para seducirlo, designarlo como Benefactor de la Iglesia Católica-Vaticanista, además de Padre y Benefactor de la Patria Nueva, es exactamente leonino, una vez que la Iglesia Católica-Vaticano recibe cuantos privilegios la humanidad y países se puedan imaginar y se puedan crear por iniciativa del parasitismo supersticioso, hechicero y religioso, como en efecto ha sucedido desde que ese Concordato fuera firmado en 1954 hasta la fecha, en tanto el país, la nación dominicana y el pueblo, la población, no ha conocido el primer atisbo de beneficio desde el seno de esa nefasta institución mágico-religiosa, que no sea ser declarados país-Estado-población como país-Estado-población interdictos, sobre los que se instituye con presunción de dictadura vitalicia un fideicomiso, esto es, tal cual lo definen los diccionarios tanto de la Lengua Española como los jurídicos y políticos.
Veamos, pues, con todo detalle y la máxima precisión este asunto.
Interdicto, según el Diccionario Político-social de Hernando Calleja.- “Del latín interdictum. Pena eclesiástica impuesta por el Sumo Pontífice, por la cual un determinado número de fieles queda privado de algún sacramento. En Derecho procesal se denomina interdicto a todo juicio sumario en el cual no se ventila el derecho de propiedad, sino el hecho de la perturbación de la posesión. En Derecho canónico es interdicto quien está sometido a la pena de interdicción”.
El término del derecho canónico pasa al derecho -digamos que- mundano o secular, y, en efecto, en el Diccionario Larousse, que es elaborado por la Iglesia Católica-Vaticano a través de una de sus tantas empresas-negocios de imprenta, que es la especialidad de la orden salesiana, de la interdicción se dice lo siguiente:
“Interdicción. Prohibición, la acción de prohibir alguna cosa; la interdicción de un comercio. ║ Restricción de los derechos de una persona o institución por un delito (interdicción penal), o por ser menor de edad, loco o imbécil, sordomudo o pródigo (interdicción civil)”.
No vamos a citar el Diccionario de la Real Academia Española por el hecho de que no aporta nada nuevo que no sea imprecisión y crear confusión, lo cual no es nuestro objetivo, y sólo beneficia al enemigo y su parasitismo social, que es nuestro deliberado blanco u objetivo.
Precisa y exactamente, con el leonino Concordato del dictador Trujillo y Eugenio Pacelli, mejor conocido por el alias el Papa nazi-fascista de Hitler o Pío XII, se declara e impone no otra cosa que una virtual y eventual o práctica de hecho interdicción al país-pueblo-Estado dominicanos, según la cual y por medio de ese adefesio unilateral del leonino Concordato de marras, se le imponen la condición de la interdicción civil, pero debe tomarse en cuenta que en general, en Derecho Civil, la interdicción es sinónimo de la capitidiminutio impuesta al menor por razón de edad; pero que al loco, al imbécil, por razón y discernimiento, así como también al mendigo, se les impone, y esto es interdicción civil, pero, además, y esto es lo principal sobre el Estado-país-población dominicanos, el leonino Concordato parasitario actual que pesa sobre nosotros, impone la pena de interdicción penal que, según el Derecho Penal, contiene y encierra la idea y el principio de prohibir o vedar, según el cual se priva al condenado de determinados derechos esenciales, restringiéndosele su personalidad jurídica.
De ahí que, en los hechos, y teórica o formalmente, el Concordato que se nos impone con carácter rotunda y definitivamente ilegal, inconstitucional e ilegítimo, acarrea que sobre el Estado-país y pueblo dominicanos se imponga un fideicomiso con carácter vitalicio, como es preferencia de la Iglesia Católica, ya que es despótica, absolutista, autocrática, monárquica e imperial, contraria en forma absoluta a la democracia y en particular a toda práctica de la democracia y de los derechos democráticos por parte de Estados, países y pueblos.
Veamos con las mismas fuentes lo que es un fideicomiso y dígasenos si no es lo que nos depara el Concordato, reforzado y apuntalado por el Vicariato Castrense y el Patronato Nacional San Rafael.
Fideicomiso, según el Larousse, es donación testamentaria hecha a una persona o institución encargada de restituirla a otra persona o institución o ejecutar alguna voluntad del testador (el que hace o dicta el testamento). Pero el asunto del Concordato leonino que nos subyuga posee el agravante de que no posee fiducia, puesto que no hay garantía de parte del parasitismo divino de la Iglesia Católica-Vaticano, de que por su mente pase siquiera en sueños la idea de devolvernos nuestra soberanía y nuestra libertad estatal, lo cual queda en todas y cada una de las esferas de la actividad de la sociedad dominicana comprobado.
Es en razón de estas realidades y verdades irrefutables que el Concordato leonino del dictador Trujillo y la parasitaria como supersticiosa y oscurantista Iglesia Católica-Vaticano resulta inexcusable.
Pero antes de concluir, digamos que nos asiste totalmente la razón y la lógica con toda su exactitud científica y objetiva cuando afirmamos que el Concordato, el Vicariato Castrense y el Patronato Nacional San Rafael en manos de la fatal Iglesia Católica, que es parte del Estado chatarra Vaticano significa la pérdida total de la autodeterminación del pueblo, y que sin esta autodeterminación quedamos huérfanos de democracia, viéndonos obligados por tales circunstancias a vivir desnudos y avergonzados, con una mano atrás y otra adelante para cubrir nuestros atributos, ya que el pueblo y su voluntad libre y soberana son la única fuente y garante de la democracia, todo lo cual es embestido y arrasado por ese adefesio leonino que es el Concordato del dictador Trujillo y el Papa de Hitler, Pío XII.

¿Qué les queda a los dinosaurios del comunísmo? atacar el cristianísmo, atacar la Iglesia Católica, atacar los evangélicos, atacar los Concordatos, los Tratados, los Convenios que se realizan en muchos países en todo el mundo con el Vaticano, se ataca la personalidad jurídica del Vaticano con el fín de confundir a los ignorantes, todo el mundo sabe que desde antes del Tratado Lateranese, ya la Iglesia era reconocida por los Estados como Sujeto de Derecho Internacional, y que a pesar de no tener territorio definido, ninguna nación retiró nunca sus Embajadores ante la Santa Sede,reconociendo implícitamente su Primacía.
En la actualidad la Santa Sede, el Vaticano, tiene representación en todas las Organizaciones donde se reúnen el concierto de todos los países, sus representantes pueden intervenir en ellos, aunque por su posición Superpartes la Santa Sede no tiene derecho al voto en dichos oraganísmos, pero sí derecho a opinar, por otra parte el Vaticano sí tiene un territorio concreto, delimitado, sí tiene ciudadanos, bandera, pasaportes etc etc, hay que estudiar, no se puede ser mezquino a la hora de ver la historia porque los argumentos se caen por su propio peso, inclusive está considerado el Estado más pequeño de mundo, no es país ni Estado para sus enemigos que quisieran hacerla desaparecer, «destruyamos la Iglesia y con ella destruiremos al hombre creyente y de buenos valores, provoquemos el caos y así pasaremos a la revolución que al final predicará una cosa y luego sus dirigentes vivirán como capitalístas secretos, porque dentro del hombre comunísta, también está el hombre pecador que flaquea y peca, el hombre que piensa, pero luego existe…»
La Declaración Universal de los Derechos Humanos, promulgada en Nueva York el 10 de diciembre de 1948. adoptada y proclamada por la Asamblea General de las Naciones Unidas. En su artículo 18 nos dice: «Toda persona tiene derecho a la libertad de pensamiento, de conciencia y de religión o su creencia individual y colectivamente, tanto en público como en privado, por la enseñanza, la práctica, el culto y la observancia».
El Estado debe de estar al servicio de la conciencia personal del individuo. el Estado, en caso de regular el factor religioso, no puede adopar una posición, sino que tiene que promover, garantizar y tutelar que cualquier ciudadano, de acuerdo con su conciencia, adopte o no una postura sobre el hecho religioso, por lo tanto, pretender un Estado aconfesional, no es eliminar el factor religioso de la vida de los ciudadanos, ya que el factor religioso se reconoce como un factor integrante del bien común, todo el mundo sabe que contribuye con el desarrollo de la personalidad de sus ciudadanos y que es un factor clave para la convivencia y para la paz social.
El problema aqui no se trata de eliminar el Concordato porque esté mal o bien hecho, se trata de que todos los dominicanos, en cuanto a sus creencias tengan el mismo tratamiento, lo que se conoce como «igualdad en la proporcionalidad» , la igualdad en lo cualitativo, pero cuantitativamente distinto, eso no va a significar desigualdad, sino que la Iglesia Católica tiene más proporción de fieles, que necesitan de la asistencia religiosa, así como la enseñanza religiosa en la escuela, más ministros de culto, más financiación…esto es lo que defiende el Concordato para su Iglesia y no se le puede concenar a desaparecer por esto ya que detrás de todo hay una realidad, la mayoria de los dominicanos profesan la religión católica, para bien o para mal no se puede borrar la Iglesia Católica de la historia del pueblo dominicano, presente en la cultura, en la moral, en el arte y en toda la vida nacional, a lo mejor se hable de las otras Confesiones religiosas, que no tienen acuerdos con el Estado, pero esta parte no es culpa de la Iglesia, el Estado y las otras Confesiones religiosas tien que sentarse en la mesa del diálogo y llegar a acuerdos, tomando como marco de referencia y mejorándolo inclusive, el Concordato, y crear leyes que garantizen sus derechos. Así como los partidos, las ideogías, el comunismo es respetado por el orden democrático, asi también la Iglesia y las Confesiones merecen el mismo respeto.
El Estado, a la hora de cooperar, de trabajar en común, toma en cuenta la valoración democrática de los grupos sociales reales y juntos son corresponsables del bien común, reconociendo el hecho diferencial de cada una de las comunidades religiosas como sujetos colectivos del derecho de libertad religiosa. Por lo tanto, no se trata de eliminar derechos fundamentales del ser humano, se trata de potenciarlos, aumentarlos.
Respeto la persona que ha escrito el artículo, porque el ser humano es digno de respeto, aunque difiera de nuestras ideas, pero las ideas equivocadas no nos merecen ningún respeto, simplemente son «ideas»… «opiniones»… a las que hay que tratar de iluminar.
A la hora de cambiar, renovar, aumentar derechos, aclarar, como bien lo especifica nuestro Concordato, sólo ambas partes tienen esta prerrogativa, que ya han usado en varias ocasiones, las partes son soberanas en eso, el Concordato es un Convenio Internacional, un Tratado Internacional, convertido en ley por nuestras cámaras legislativas, contiene derechos que son de antes de la creación del Estado.
